By accessing, downloading, or using the NOMI Stamps app, shop owner portal, or website (collectively, "the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms form a legally binding agreement between you and NOMI Stamps. If you do not agree, do not use the Platform.
These Terms apply to all users of the Platform, including customers who collect loyalty stamps and shop owners who operate loyalty programmes. Where terms differ between these groups, we say so clearly.
We may update these Terms from time to time. We will notify you of significant changes through the app or by email. The updated Terms become effective on the date posted. Your continued use of the Platform after that date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Platform and delete your account.
In these Terms:
To use NOMI Stamps as a customer you must be at least 13 years of age. By using the Platform you represent that you meet this requirement. Users aged 13–17 should have the consent of a parent or guardian.
To register as a shop owner you must be at least 18 years of age and be legally authorised to operate the business you register. By registering a business, you represent and warrant that you have the legal authority to enter into these Terms on behalf of that business and to bind it to all obligations set out herein.
NOMI Stamps is available in Australia. Use of the Platform from outside Australia is at your own risk and subject to applicable local laws.
4.1 Account creation
You must provide accurate, current, and complete information when registering an account and keep it updated. Providing false or misleading information may result in immediate account termination.
4.2 Account security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not share your account credentials with any other person. If you are a shop owner, you must ensure that any staff who access the Platform on your behalf do so under your supervision.
4.3 Unauthorised access
You must notify us immediately at hello@nomistamps.com if you suspect that your account has been accessed without your authorisation or that your credentials have been compromised. We are not liable for any loss arising from unauthorised access where you have not notified us promptly.
4.4 One account per person
Customers may hold one account per person. Creating multiple accounts to accumulate stamps or circumvent restrictions is prohibited and will result in termination of all associated accounts.
4.5 Account suspension
We reserve the right to suspend access to any account that appears to have been compromised, used fraudulently, or in breach of these Terms, pending investigation.
NOMI Stamps provides a digital loyalty platform that enables customers to collect stamps at participating shops and redeem rewards. Shop owners use NOMI Stamps to manage their loyalty programme, publish deals, and view analytics.
NOMI Stamps is a technology platform only. Individual shops are independently owned and operated businesses. NOMI Stamps does not control shops' business decisions, including the stamps they issue, the rewards they offer, their opening hours, pricing, product quality, or availability. Accordingly, NOMI Stamps is not responsible for:
NOMI Stamps reserves the right to add, modify, suspend, or discontinue any feature of the Platform at any time with reasonable notice where practicable.
6.1 Nature of stamps
Loyalty stamps have no monetary or cash value whatsoever. Stamps cannot be transferred, gifted, sold, exchanged for money, or combined across different accounts. Stamps earned at one shop cannot be used at another shop. They are a record of your loyalty activity with a specific shop only.
6.2 Stamp issuance
Stamps are issued at the sole discretion of the shop operator. NOMI Stamps does not control how many stamps a shop assigns per transaction. NOMI Stamps is not responsible for stamp errors caused by staff, connectivity issues, or device malfunction. In the event of a disputed stamp, the customer should contact the shop directly in the first instance.
6.3 Reward redemption
When a customer reaches the stamp goal set by a shop, a redemption option appears on their loyalty card. The customer must present the redemption screen to shop staff to claim the reward. NOMI Stamps is not liable if a shop is unable or unwilling to honour a reward, or if the redemption screen cannot be displayed due to connectivity issues.
6.4 Deals and promos
Deals are published at each shop's sole discretion and are subject to the conditions, time windows, date restrictions, and usage limits set by that shop. NOMI Stamps does not guarantee the accuracy, availability, or value of any deal. NOMI Stamps is not responsible if a shop is unable or unwilling to honour a deal.
6.5 QR code expiry
Each QR code generated through NOMI Stamps expires 30 seconds after generation and is valid for a single scan only. Expired or already-used codes cannot be honoured. NOMI Stamps is not liable for failed stamp credits or redemptions caused by QR code expiry, poor lighting, connectivity issues, or device malfunction.
6.6 Programme changes
Shops may modify or discontinue their loyalty programmes at any time, including changing the stamp goal, reward type, or deal conditions. NOMI Stamps will endeavour to notify customers of significant changes to programmes of shops they follow, but cannot guarantee advance notice in all cases.
6.7 Stamp expiry
Stamps do not expire while your account is active. If you delete your account, all stamps are permanently deleted. NOMI Stamps does not guarantee that stamps will be honoured in the event that a shop ceases to participate in the Platform.
7.1 Joining as a shop
By registering as a shop on NOMI Stamps, you represent and warrant that: you are authorised to operate the business; all information you provide is accurate and up to date; your loyalty programme and deals comply with all applicable laws including the Australian Consumer Law; and you have the right to use any images or content you upload.
7.2 Shop obligations
As a shop owner on NOMI Stamps, you agree to:
7.3 Content standards
All content you publish through NOMI Stamps — including your shop description, promo titles, and deal descriptions — must be accurate, legal, and not misleading. You must not publish content that is false, defamatory, offensive, discriminatory, or in breach of any third-party intellectual property rights. NOMI Stamps reserves the right to remove content that breaches these standards without notice.
7.4 Shop listing removal
NOMI Stamps reserves the right to remove or suspend any shop listing that: breaches these Terms; receives repeated verified complaints from customers; engages in deceptive or misleading conduct; or brings the NOMI Stamps Platform into disrepute. We will endeavour to provide notice before taking such action except where immediate removal is necessary to protect users or the Platform.
You agree not to use the Platform to:
Breach of this section may result in immediate account suspension or permanent termination without prior notice and without refund of any subscription fees paid.
9.1 NOMI Stamps' intellectual property
All content, design, code, software, algorithms, processes, branding, and technology that make up the NOMI Stamps Platform — including but not limited to the QR token generation and validation system, HMAC-SHA256 signing mechanism, stamp crediting flow, nonce-based replay prevention, loyalty card design system, analytics engine, and all associated software — are owned by or licensed to NOMI Stamps and are protected by Australian and international intellectual property laws including the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth), and applicable patent laws.
9.2 Licence to use the Platform
Subject to your compliance with these Terms, NOMI Stamps grants you a limited, non-exclusive, non-transferable, revocable, royalty-free licence to access and use the Platform for its intended purpose — collecting loyalty stamps (customers) or operating a loyalty programme (shop owners). This licence does not include any right to:
9.3 Your content
You retain ownership of content you submit to NOMI Stamps (such as your shop description, promo images, and listing details). By submitting content, you grant NOMI Stamps a worldwide, non-exclusive, royalty-free licence to use, store, display, and distribute that content solely for the purposes of operating and promoting the Platform. This licence ends when you delete the content or your account.
9.4 Feedback
If you submit feedback, suggestions, or ideas about the Platform, you grant NOMI Stamps the right to use that feedback without restriction and without any obligation of confidentiality or compensation.
9.5 Enforcement
Any unauthorised use of NOMI Stamps' intellectual property may result in termination of your account, legal action, or both. We actively monitor for platform abuse and IP infringement.
The NOMI Stamps QR stamp system is purpose-built with cryptographic controls to ensure that stamps are only issued for genuine transactions:
Any attempt to reproduce, replay, intercept, forge, or manufacture QR codes — including by technical means such as screen recording, packet capture, binary analysis, or reverse engineering — is a material breach of these Terms and may constitute fraud under Australian law, including under the Criminal Code Act 1995 (Cth).
NOMI Stamps actively monitors for anomalous stamp patterns. Accounts found to be engaged in stamp fraud, QR manipulation, or systematic abuse of the loyalty system will be terminated immediately and without refund. We reserve the right to report suspected fraud to relevant law enforcement authorities.
11.1 Plans and pricing
Access to the NOMI Stamps shop portal is provided on a subscription basis. Current plans and pricing are listed at nomistamps.com. All prices are in Australian dollars (AUD) and include applicable GST. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.
11.2 Free trial
New shop accounts receive a 2-month free trial with full Double Shot plan access. No credit card is required to begin the trial. The trial begins on the date of account creation. At the end of the trial period, continued access requires selection of a paid subscription plan. If no plan is selected, access to the shop portal will be suspended until a subscription is established.
11.3 Billing and auto-renewal
Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorise NOMI Stamps to charge your nominated payment method on a recurring monthly basis until you cancel. We will send a receipt to your account email after each successful charge.
11.4 Cancellation
You may cancel your subscription at any time through Settings → Delete account, or by contacting hello@nomistamps.com. Cancellation takes effect at the end of the current billing period. You will retain access to all paid features until that date. Deleting your account simultaneously cancels your subscription and initiates a 60-day data retention period after which all associated data is permanently deleted.
On multi-location plans, individual locations may be removed via Settings without deleting your account. Removed locations are deactivated immediately and all associated data is held for 60 days. You may restore a removed location from Settings within that window. If not restored within 60 days, all associated data is permanently deleted.
11.5 Refunds
Subscription fees are non-refundable for the current billing period upon cancellation, except where required by Australian Consumer Law. If you believe you have been charged in error, contact hello@nomistamps.com within 30 days of the charge.
11.6 Failed payments
If a payment fails, we will notify you by email and attempt to collect payment again. If payment remains outstanding after 7 days, we may suspend access to the shop portal. If payment is not received within 30 days, we reserve the right to terminate the account.
11.7 Consumer law rights
Nothing in these Terms excludes or limits any rights you may have as a consumer under the Australian Consumer Law, including any applicable consumer guarantees. To the extent that any provision of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails.
We aim to provide a reliable and continuously available service, but we do not guarantee uninterrupted availability. The Platform may be unavailable from time to time due to maintenance, upgrades, third-party outages, or circumstances beyond our control.
We will endeavour to provide advance notice of planned maintenance where possible. We are not liable for any loss, inconvenience, or missed stamps caused by Platform downtime or unavailability.
NOMI Stamps does not guarantee that QR codes will scan successfully in all environments. Lighting, device camera quality, internet connectivity, and other factors outside our control may affect scan performance.
The Platform relies on third-party services including Supabase, Stripe, Mapbox, Expo, and Resend. The availability of the Platform is in part dependent on the availability of these services. We are not liable for outages or failures caused by third-party providers.
By using the Platform you acknowledge that you may also be subject to the terms and conditions of these third-party providers where their services interact directly with you (for example, Stripe's terms when processing subscription payments).
Links or references to third-party websites within the Platform are provided for convenience only. NOMI Stamps does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party website.
Your use of the Platform is also subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and protect your personal information. By using the Platform, you consent to the data practices described in the Privacy Policy.
To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
We do not warrant that: the Platform will meet your specific requirements; the Platform will be available at any particular time or location; any errors or defects will be corrected; the Platform is free of viruses or other harmful components; or the results of using the Platform will be accurate or reliable.
Nothing in this section affects any non-excludable rights you may have under Australian Consumer Law.
16.1 Indirect loss
To the maximum extent permitted by applicable law, NOMI Stamps and its directors, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage of any kind, arising out of or in connection with your use of or inability to use the Platform. This includes but is not limited to:
16.2 Cap on liability
To the maximum extent permitted by law, NOMI Stamps' total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform shall not exceed the greater of: (a) the total subscription fees you paid to NOMI Stamps in the 12 months immediately preceding the claim; or (b) AUD $100.
16.3 Exceptions
Nothing in these Terms excludes or limits liability for: death or personal injury caused by NOMI Stamps' negligence; fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded or limited under the Australian Consumer Law or any other applicable law.
16.4 Independent allocation of risk
The limitations in this section reflect a fair allocation of risk between you and NOMI Stamps. These limitations will apply even if any remedy fails of its essential purpose.
You agree to defend, indemnify, and hold harmless NOMI Stamps and its directors, officers, employees, agents, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Platform; your breach of these Terms; your Content; your violation of any third-party rights; or any fraudulent or unlawful conduct by you.
18.1 Termination by you
You may stop using the Platform at any time. Customers may delete their account via Profile → Delete account. Shop owners may delete their account via Settings → Delete account. Deletion terminates your access and initiates permanent data removal as described in the Privacy Policy.
18.2 Termination by NOMI Stamps
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we determine that you have: breached these Terms; engaged in fraudulent, abusive, or illegal conduct; threatened the security or integrity of the Platform; or acted in a way that is harmful to other users, shop partners, or NOMI Stamps' reputation.
In cases of serious breach (including fraud or QR manipulation), we may terminate immediately and without refund.
18.3 Effect of termination
On termination, your right to access the Platform ceases immediately. Sections 9 (Intellectual property), 10 (Platform integrity), 15 (Disclaimer), 16 (Limitation of liability), 17 (Indemnification), 20 (Governing law), and 21 (General provisions) survive termination.
We reserve the right to modify, add, or remove features from the Platform at any time. For significant changes that affect paid plan features, we will provide at least 14 days' advance notice. You may cancel your subscription within the notice period if you do not accept the changes.
We are not liable for any loss caused by modifications to the Platform, provided we have given reasonable notice where practicable.
Neither party is liable for any failure or delay in performance caused by circumstances beyond their reasonable control, including but not limited to: natural disasters, pandemic, government action, internet or telecommunications outages, third-party service failures, cyberattacks, or power failures. The affected party must notify the other party promptly and take reasonable steps to minimise the impact.
21.1 Governing law
These Terms are governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
21.2 Informal resolution
Before initiating any formal legal proceedings, you agree to contact us in good faith at hello@nomistamps.com to attempt to resolve the dispute informally. We will use reasonable efforts to resolve any dispute or concern within 30 days of receiving written notice.
21.3 Consumer rights
Nothing in this section limits any rights you may have to take a dispute to the Australian Competition and Consumer Commission (ACCC), Consumer Affairs Victoria, or any other applicable consumer protection body.
22.1 Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and NOMI Stamps regarding your use of the Platform and supersede all prior agreements, representations, and understandings.
22.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions continue in full force and effect.
22.3 Waiver
No failure or delay by NOMI Stamps in exercising any right under these Terms constitutes a waiver of that right. A waiver of any breach does not constitute a waiver of any subsequent breach.
22.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without NOMI Stamps' prior written consent. NOMI Stamps may assign these Terms (in whole or in part) in connection with a merger, acquisition, or sale of assets, provided that the assignee assumes all obligations under these Terms.
22.5 Notices
We will send notices to you at the email address on your account. Notices from you to NOMI Stamps should be sent to hello@nomistamps.com. Notices are deemed received on the next business day after sending.
22.6 No agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and NOMI Stamps.
