1. Acceptance of terms

By downloading, accessing, or using the nomi app ("App") you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use nomi. By using the App, you represent that you meet this requirement. Users under 18 should have parental or guardian consent.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please notify us at hello@nomistamps.com if you suspect unauthorised access.

You agree to provide accurate and complete information when creating your account and to keep it up to date.

4. The nomi service

nomi provides a digital loyalty card platform that allows you to collect stamps at participating cafés, redeem rewards, and access exclusive promotions and deals as determined by each café. nomi acts as a technology platform only. Individual cafés are independently operated and are responsible for:

• Determining stamp and redemption conditions
• Honouring earned rewards and promotions at their discretion
• The accuracy and availability of their promotions
• The quality of their products and services

5. Loyalty stamps, rewards & promotions

Loyalty stamps have no cash value and cannot be transferred, sold, or exchanged for money. Stamps are tied to the specific café that issued them.

nomi does not guarantee the availability or continuity of any café's loyalty programme or promotions. Cafés may modify or discontinue their programmes at any time.

Promotions and deals are offered at each café's discretion and may be subject to time windows, day restrictions, and usage limits as set by the café. nomi is not responsible if a café is unable or unwilling to honour a promotion or reward.

Redemption of rewards and promotions is verified via time-limited QR codes. Expired QR codes cannot be honoured. nomi is not liable for failed redemptions caused by connectivity issues or QR code expiry.

6. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to manipulate, duplicate, or fraudulently generate stamps or QR codes
• Attempt to redeem promotions or rewards outside of their stated conditions
• Reverse engineer, decompile, or tamper with the App
• Use automated tools to access the App or our systems
• Upload or transmit any harmful or offensive content
• Impersonate any person or entity

Violation of these terms may result in immediate account suspension or termination.

7. Intellectual property

All content in nomi, including its design, logo, text, and software, is owned by or licensed to nomi and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of warranties

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, nomi makes no warranties regarding the App's availability, accuracy, or fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by applicable law, nomi shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including any loss of stamps, rewards, or data.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud.

10. Termination

You may stop using the App and delete your account at any time. We reserve the right to suspend or terminate your account if you breach these Terms or engage in conduct harmful to the platform or its users.

11. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
